Terms of Service

These Terms of Service (“Terms”) govern access to and use of the HiBooWoo service (“HiBooWoo”, “we”, “us”, “our”). By creating an account, accessing, or using the service, you agree to these Terms. If you do not agree, do not use the service.

1. The Service

HiBooWoo provides tools to track and organise books, movies, and games for personal use and for households or small groups (for example, shared libraries, lending, notes, and related features). Features may change over time.

2. Eligibility and Accounts

You must be legally capable of entering into a contract to use the service. You are responsible for safeguarding your account, credentials, and devices, and for all activity under your account. You must provide accurate information and keep it up to date.

3. Acceptable Use

You agree not to: (a) break applicable laws; (b) attempt unauthorised access, probing, or disruption; (c) interfere with the service, systems, or other users; (d) upload malware or harmful code; (e) scrape or harvest data in a way that is abusive, excessive, or violates these Terms; (f) use the service to infringe intellectual property rights or privacy rights; or (g) misuse group features (for example, impersonation or harassment).

4. User Content and Responsibility

“User Content” means content you submit to the service, including titles, notes, categories, identifiers, and images you upload. You are responsible for ensuring you have the right to submit User Content and that it is lawful and does not violate the rights of others. You represent and warrant that your User Content complies with these Terms and applicable law.

5. License You Grant to HiBooWoo (User Content)

You retain ownership of your User Content. To operate the service, you grant HiBooWoo a worldwide, royalty-free, sublicensable (through our service providers), and transferable license to host, store, reproduce, process, modify (for example, resize, compress, crop, reformat), display, and distribute your User Content solely as needed to provide, maintain, secure, and improve the service.

This includes automated processing such as extracting visible information, generating cover images, applying classifications or tags, and organising items within the service. Any such processing is performed for functional, organisational, and safety purposes and does not add, enhance, or promote the content you upload.

Community reuse of uploaded artwork: If you explicitly enable community reuse (for example, by a setting or an upload choice), you additionally grant HiBooWoo a perpetual, worldwide, royalty-free license to use, reproduce, modify, display, and distribute the images you mark as reusable to improve the catalogue and experience for other users (including showing those images as cover options). If you do not enable community reuse, your uploaded images are used only for your account or your permitted groups.

6. Automated Processing and Derived Data

As part of operating the service, HiBooWoo may generate metadata derived from User Content, such as normalised titles, identifier mappings, classifications, confidence scores, and aggregated statistics. This derived data may be combined across users in an anonymised and non-identifiable form.

HiBooWoo may use such aggregated and anonymised derived metadata to operate, improve, and develop the service and related products or datasets. This does not include selling or disclosing individual user libraries, personal content, or identifiable user data.

7. Third-Party Content and Providers

The service may display or reference content from third-party sources (for example, metadata or images from external providers). Such content may be subject to third-party terms and restrictions. HiBooWoo does not grant you rights to third-party content beyond what is required for normal use of the service.

8. Adult Content Controls

Some works or images may be marked as adult or sensitive content, including through automated classification. The service may apply visibility controls (for example, hiding such content by default) to support household safety. You are responsible for choosing settings appropriate for your household or group and for ensuring any use complies with applicable law.

9. Moderation, Takedowns, and Enforcement

We may remove or restrict access to User Content, suspend features, or terminate accounts if we believe content or behaviour violates these Terms, applicable law, or third-party rights, or if needed to protect users, the service, or our legal obligations. We may (but are not required to) review, moderate, or monitor content. You can report content via in-product reporting or our contact form.

10. Paid Plans, Billing, and Renewals

HiBooWoo may offer paid plans billed annually unless stated otherwise at purchase. Prices, taxes (if applicable), and plan features are shown at checkout. By purchasing, you authorise us (or our payment processor) to charge your selected payment method. Unless you cancel before renewal, paid plans may renew automatically on the then-current terms.

11. Cancellations and Refunds

You may cancel a paid plan according to the options shown in your account. Refunds (if any) are governed by the terms shown at purchase and any non-excludable rights under applicable law.

12. Availability; Disclaimers

The service is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted access or that the service will be error-free.

13. Limitation of Liability

To the maximum extent permitted by law, HiBooWoo’s total liability for any claim arising out of or relating to the service will not exceed the amounts you paid to HiBooWoo in the 12 months preceding the claim (or £50 if you have not paid).

14. Indemnity

If you are using the service for business purposes or as a group owner, you agree to indemnify HiBooWoo to the extent permitted by law.

15. Termination

You may stop using the service at any time. We may suspend or terminate access if you violate these Terms or must comply with legal obligations.

16. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide reasonable notice and may require acceptance to continue using the service.

17. Privacy

Our Privacy Policy explains how personal data is handled. Please review it alongside these Terms.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales, subject to mandatory consumer protection laws.

19. Language

In case of inconsistency, the English version of these Terms prevails.
